1. General Provisions
1. Department of Education of Kostanay region (hereinafter the Department) is a government agency that implements the basic principles of state policy in education, aimed at ensuring the constitutional rights of citizens of the Republic of Kazakhstan on education.
2. Full name of legal entity in the state language is «Қостанай облысы әкімдігінің білім басқармасы» мемлекеттiк мекемесi.
Full name of legal person in Russian: «Управление образования акимата Костанайской области».
3. Management is guided by the Constitution of the Republic of Kazakhstan, President's legislative acts, regulations of the Government of the Republic of Kazakhstan, other normative legal acts of the Republic of Kazakhstan and these regulations.
4. The Department is a legal entity with its own balance sheet, in accordance with the law has an account in the regional offices of the Treasury, letterheads with its name in Kazakh and Russian languages, printing, and stamps with the State Emblem of the Republic of Kazakhstan with its name in the official language.
The Department has no branches or representative offices.
5. Regulations on the Department and staff number limit is approved by the Office of akimat Kostanay region.
6. The Department enters into civil law relations in its own name.
7. The founder of the Department is akimat of Kostanay region.
The constituent documents of the Department are a resolution of akimat of Kostanay region and these Regulations.
Changes and additions to the present situation can be made by the Founder.
8. Funding of the Department is carried out from the regional budget.
9. Registered address of the Department: 110000, Republic of Kazakhstan, Kostanayi, Al-Farabi Avenue, 56.
2. The subject, purpose and mission of the Office
10. The subject of the Department is to create the necessary conditions for education, aimed at the formation, personal and professional development of the individual on the basis of national and universal values, science and practice.
11. The objectives of the Department:
1) a continuous process of education and training, a high level of moral, intellectual, cultural and physical development and professional competence of members of society;
2) ensuring the constitutional right of citizens of the area of education;
3) implementation of a unified state policy in the field of educational organizations.
12. The main task of state institutions:
1) creation of conditions for the development of educational programs;
2) development of creative, spiritual and physical strength of a person, forming a solid foundation of morals and a healthy lifestyle, the enrichment of the intellect by creating an environment for the development of individuality;
3) The development of citizenship and patriotism, respect for state symbols, reverence of traditions, intolerance to any anti-constitutional and anti-social manifestations;
4) formation of the needs to participate in the political, economic and cultural life of the country, understand the relationship of personality to their rights and responsibilities;
5) introduction to the achievements of world and national culture, the history, customs and traditions of the Kazakhs and other peoples of the republic, the mastery of the state, Russian and foreign languages;
6) expansion of autonomy and independence of educational institutions, democratization and decentralization of education management;
7) The introduction of new teaching technologies, the computerization of education, access to international global communication networks;
8) the training of skilled workers and specialists, competitive labor market, retraining and upgrading their skills;
9) training and retraining of redundant workers and the unemployed;
10) promote the efficient development of diverse and multifunctional educational organizations.
3. Functions and powers of the Office
13. The main functions of the Department include:
1) Propose the development program of education to the population;
2) Ensure the provision of initial vocational training to citizens;
3) provision of educational programs of secondary professional education;
4) provision of general education courses in special education programs;
5) provision of general education courses for gifted children in special education institutions;
6) organization of the official blank documents on state-level education and training, provision of educational organizations that provide basic general education and general secondary, primary vocational and secondary vocational education and exercise control over their use;
7) proposals to the city administration for the creation, transformation and liquidation of educational institutions in accordance with the laws of the Republic of Kazakhstan;
8) ensuring the acquisition and delivery of textbooks and teaching materials for the state regional educational organizations;
9) holding school contests on the regional scale;
10) Organization of retraining and further training of employees in state institutions financed from the budget;
11) provide a survey of mental health of children and adolescents and the provision of psychological, medical and educational advice to the public;
12) licensing organizations of educational activities, as well as for state certification of entities that implement basic and advanced programs of primary vocational and secondary vocational education, professional and special education programs and programs of additional education for children and youth in sport;
13) Development of a draft resolution for approval of akimat of the state educational order for the training of primary professional, secondary professional education;
14) Support and assist in the logistical support of public education institutions that provide primary vocational and secondary vocational education and special education and specialized organizations;
15) rehabilitation and social adaptation of children and adolescents with developmental problems;
16) provide necessary services to orphans, children left without parental care, ensure their mandatory employment and housing;
17) the organization of free and reduced price meals of certain categories of students in accordance with the legislation of the Republic of Kazakhstan;
18) To promote employment of graduates of educational institutions that provide vocational education;
19) organization of a unified national test and the interim government control in educational organizations that provide secondary education in order to check the development of learner educational content at the corresponding level.
14. The Department to implement its tasks and carry out its functions shall be entitled to the law:
1) to assess the quality of the organization of educational process in educational institutions;
2) within its jurisdiction comply with the Law of the Republic of Kazakhstan "On Education";
3) within its competence to carry out certification in the prescribed manner of teaching staff of educational institutions;
4) to computerize the system of secondary education;
5) within its competence to request and receive from state bodies, legal entities with state and other organizations and individuals the necessary information and documents;
6) The Department along with the rights specified in these Regulations shall have other rights granted to it by legislation of the Republic of Kazakhstan.
4. The assets of the Department
15. The Department has separate property.
16. The Department's property is formed from the assets transferred to it by the founder (property owner), and consists of fixed assets and working capital and other assets whose value is reflected in the balance of the Department.
17. The Department has no right to alienate or otherwise dispose of the property assigned to it.
5. Organization of the Office
18. The Department is headed by a Head appointed and dismissed by the Governor of Kostanay region in accordance with the laws of the Republic of Kazakhstan.
19. Head of Department has a deputy (deputies) appointed and dismissed from the post by the Head of the Department in accordance with legislation.
20. Head of Department:
1) Organizes and directs the work of the Department;
2) is personally responsible for implementation of the management functions;
3) appoints and dismisses employees of the Department in accordance with legislation;
4) defines the powers and duties of deputies, heads of divisions and other senior officials of the Department;
5) approves the management structure;
6) approves the provision of parts of the Department;
7) signs orders and binding upon the employees of the Department instructions;
8) is the manager of executive agencies and organizations in accordance with the laws of the Republic of Kazakhstan;
9) in the manner prescribed by law imposes disciplinary sanctions on employees of the Department;
10) decides on other matters within its competence.
21. At the time of the absence of the head of his duties shall be the deputy, appointed by the head.
22. Head of the Department establishes a consultative advisory collegial body whose decisions are made by the order.
6. Responsibility of the Department
23. The Department is responsible for disposal of its money. If there is insufficient money liability for its obligations lie with the owner of the property.
7. Reorganization and Liquidation Office
24. Reorganization or liquidation is done by the decision of the Office of Akim of Kostanay region in accordance with the applicable laws of the Republic of Kazakhstan.
25. Assets remaining after liquidation shall be submitted to the owner.
